Sounds like a gray area to me. The contractor is not the contractor who built your house. If the ad gives the impression that he is the company that built your house this would at least be fraudulent but he would be defrauding the public not you. If someone takes a picture of you and uses that picture for commercial gain then they can be sued by you if you did not sign a model release giving them permission. In this case a picture of your house may similarly by an invasion of privacy and you may have a case OR then again you may not. Is you house that much different than all the other homes in the area? Would people viewing the picture know whose house it was? Would their knowing and connecting your house with the ad give them a false impression of you? These questions and others and the answers to them would determine if in fact your rights to privacy may be violated by such commercial use of a photograph of your personal property. A lot of it has to do with the “commercial use” If someone just took a picture of your home because they found it to be beautiful and the picture ended up in a newspaper or magazine as an example of what a fine home should look like but the photographer and periodical made no substantaial commercial gain from the photo there would likely be nothing you could do and why would you want to. BUT if the photo is used in advertising it crosses a line or if your home was something to be ashamed of because it was in disrepair, again this could be an invasion of privacy IF the home was off the beaten path at the end of a long private driveway out of view of the public but if it was along a well traveled highway where it was visible to the public, well what case would you have?

So, can a company use an image of your home for advertising without consent? Probably unless you and your lawyer feel that you have good legal reasons for not permitting it but you had better be prepared to prove those reasons.

You know what Checker, I am particular about spelling myself, and like you have had a bilingual education and also studied an additional Indian language and a foreign language too. We have the advantage of having a curriculum that was based on the British schooling system with strong emphasis on grammar and spelling. I think the gecko would be way too stressed out. I’d rather leave alot of extra food in the tank. Get the smaller crickets they won’t nip at your gecko and just put them in before you leave. Also get a mealworm container that won’t let them get out and put alot in. They don’t drink alot so just ask your step brother to please mist the walls of the tank everyday .
